Navigating Flood Insurance & Filing a Complaint

When dealing with flood-related damage, understanding your insurance options and knowing how to address issues with your insurance provider is crucial. Here’s a brief guide to help you navigate flood insurance and the complaint process.

Flood Insurance Guidance

The National Flood Insurance Program (NFIP), managed by FEMA, provides flood insurance to property owners, renters, and businesses. This program is delivered through a network of over 50 insurance companies and the NFIP Direct. It’s important to know that flood insurance policies are separate from standard homeowners' insurance and are designed specifically to cover flood-related damages.

Filing a Complaint

If you’re experiencing issues with your insurance provider, such as delays in claim processing or disputes over coverage, the Nevada Division of Insurance is available to assist. Although they do not provide specific guidance on dealing with insurance companies during disasters, they do offer a way to file a complaint if you’re facing problems.

How to File a Claim for Damages Against Washoe County

Risk Management Division

If you believe you have a compensable claim against Washoe County, the Risk Management Division 

of the Comptroller’s Office is responsible for investigating these claims. Below is a simple guide to help you through the process.

Important Considerations
  • Infrastructure Performance: During events like the July 2024 flood, the stormwater infrastructure in Washoe County was constructed to code and performed as designed. Washoe County considers claims only if it is proven that the County acted negligently.
  • Legal Notice: Be aware that Nevada Revised Statutes (NRS) 197.160 states that knowingly presenting a false or fraudulent claim is a gross misdemeanor and may result in penalties, including imprisonment and fines.
Step 1: Contact Risk Management

Before filing a claim, please reach out to Washoe County Risk Management at 775-328-2665 for assistance or to discuss your situation. This can help clarify any doubts and ensure that your claim is properly documented.

Step 2: Complete the Notice of Claim Form

You will need to fill out the "Notice of Claim for Damages Against Washoe County" form, which you can download here. The form requires you to provide detailed information about:

  • Claimant Information: Your personal details, including your home and mailing addresses, contact numbers, and employer information.
  • Accident/Incident Details: The date, time, and location of the occurrence, along with a detailed description of how it happened.
  • Witnesses: Names and contact information of any witnesses.
  • Police Report: Information about the law enforcement agency involved and the police report number, if applicable.
  • Damage or Injury: A description of any property damage or bodily injury, including photos and repair estimates if available.
  • Total Amount Claimed: You must indicate the total amount of damages you are claiming.

Note: If your claim involves bodily injury, additional documentation such as medical records and bills will be required.

Step 3: Submit the Form and Supporting Documents

Once you have filled out the form and gathered all necessary documentation, you can submit your claim in one of the following ways:

  • Email: Send the completed form and attachments to RiskMgmt@washoecounty.gov.
  • Mail: Mail the original signed form and supporting documents to:

Additional Assistance

If your claim is accepted, a release form will be mailed to you, which you must sign and return. After receipt of the signed release, you will be issued a settlement check.
